Brothers in ‘honour’-beating evade jail
Reporter: Court Reporter
Date online: 08/02/2010
TWO student brothers who turned to violence over a matter of family honour, evaded a jail sentence because a court was told it was out of character for both.
Nazrul Hussain (21) and his brother Fazrul (18) kicked and beat a former neighbour because they believed he had taken photographs of their younger sister and invited her into his home.
Kayas Miah was kicked twice by the older brother after being knocked to the ground.
He was so badly injured by the beating that he was kept in hospital for two days.
Sentencing them at Manchester’s Minshull Street Crown Court, Judge Mushtaq Khokar told them: “However ill-feeling arose, you must recognise that your conduct was absolutely diabolical.
“You acted like thugs in the way you assaulted your victim, kicking him when he was on the floor. Anything like this has to be treated very seriously by the courts.”
Charlotte Crangle, prosecuting, said there had been previous ill-feeling between the Hussains and Mr Miah, who at the time had lived next door to them in Plato Street, Oldham.
She said on the day of the attack, in January last year, it spilled over into anger and violence. The elder brother first punched and kicked him, then when he was on the ground he kicked him again. His younger brother joined in.
Mr Miah was left with a swollen face, he was cut and bleeding, and two of his teeth had been loosened.
The court was told that when interviewed by police about what had happened the brothers claimed to have acted in self-defence because Mr Miah had been carrying a stick.
Both were described in court as being respectable young men, with no previous convictions, and from a good family.
Nazrul is in the final year of a degree course at Huddersfield University, and Fazrul is an A-level student at Oldham Sixth-Form College.
The brothers who live with their parents in Plato Street, Oldham, pleaded guilty to a single charge of assault occasioning actual bodily harm.
Both were sentenced to 12 month community orders and will have to carry out 150 hours unpaid work.
Judge Khokar told the older brother: “This conviction may well put you at risk of being deprived of job opportunities in the future, and that is punishment in itself.”
Have Your Say
I am not sure how these thugs can be said to be acting 'out' of character when we are constantly being told that 'honour' killings and beatings are part of the Islamic culture which we are asked to accept & embrace in our multi-cultural society.
Sorry guys but I think you are both wrong. It is the reporter who used the word "honour" that seems to have set both of you on the anti-islamic path. Who amongst us would not protect a younger sister if we perceived a case of abuse. This is nothing to do with race or religion.
flake - Doesn't matter how many times you repeat a myth doesn't make it true. Plenty of examples in the Evening Chronicle of "light sentences" and some aren't even Asian, waht do you put that down to? or do you ignore that because it doesn't fit in with your right-whinge philosophy.
idid...- Who told you honour killings are part of Islam, they are actually part of a backward uneducated culture and culture is not only influenced by religion. Did Christianity drive the IRA to bomb other Christians?
Dont ever accept "honour Killings and beatings",and please let me know where you are forced to accept them in a "multi-cultural" society and I will voice my oppostion next to yours!!
So Judge Khokar, exactly how many neighbours do you have to assault during your short lifetime (18 & 21)before you are considered to be risk to society and deserve a custodial sentence ? The fact that they might not be able to get a job is completely irrelevant and appears to be a cop out.
Yet again proof one law for one, one for another, and we wonder why certain right wing groups are gaining favour with the public
So, as I have never previously been in any form of trouble with the police, I know I can now go out and beat up some innocent victim and not expect a jail sentance - all because of my previous good behaviour. Of course, would Judge Khokar take the same view of my wrong-doings or would I need Judge Smith ???
They should be in prison and most right thinking people will agree. What made me smile though was the reason the judge gave for not handing down a custodial sentence ! most criminals in this area of Oldham would have been called deprived !!!!! and that would have been a good enough excuse not to punish them at all. They must have laughed all the way home.Hope the victim as made a full recovery.
TUT TUT TUT......its that word "honour beating" again.
They were described in court as being respectable young men. No they aren't. Respectable young men do not behave in such a way. This is a fine example of how imported customs are at odds with this country's culture.
Sorry fighback but there is enough evidence to show that the 'myth' is actually true.
Nu Labour have made veryone so frightened of being accused of racism, that they alway err on the side of caution, it's much safer than having their career wrecked by some militant leftie.
It's not a whinge about Asians, it's a whinge about the loony left which cannot see the damage it does.
Old Mancunian If I think you have taken a photograph of my daughter would that make it acceptable to get two familt thugs to beat you up, even if there was no evidence you actually did?
These two did not perceive a case of abuse, they simply thought he had invited her to his house - hardly abuse.
It is not acceptable to take the law into your own hands like this.
well before u guys judge them both boyz, you have to see why they beat the guy up, whats the reason behind it. Am from oldham and what i've heard is their next door neighbour constantly manipilating their 8years old sister. If someone did that to my sis i would have done the same, some one needs to sort them pedo's out!.
I agree that the behaviour is not acceptable. I don't agree with the infernece of a two teir system or as Ididsaythat puts it Islamic culture references. I just don't think this is a race or religious issue.
Flake - So what is the reason for other light sentences when people aren't from a certain background, dont answer half the question, it only goes to show....
keith- Right whingers making stuff up is nothing new.
Why are other sentences also light when people are not from your target background, why dont you ever mention their origin or does that not fit in with your views and needs to attack certain people only.
Fightback you in one sentence call honour beating a myth, then go on to say they exhist in backward cultures, hence the tradition go on, and as for the IRA they did not bomb people in the cause of religion they wanted a united Ireland but they did not beat the crap out of some one for looking at other family members.
so coz someone was taking photos of his sister(any proof/dont condone him if he did)so it ok to go about and kick and beat a person so next time im in town and someone gropes my partner its ok to knock 10 bells out them has these two beat a man for taking a pic and see wat sentence i get i would get at least a jail term
scotland - just for you I'll repeat it "who told you honour killings are part of Islam..." They exist in backward cultures and are not part of Islam, now do you comprehend?
Catholics (IRA) target Protestants, Protestants (loyalists!)target Catholics but its not religious - Are you sure?
Scotalnd - Beatings, knee cappings, tarring and feathering for robbery, joyriding and other "minor crimes" were extra- judicial summary punishments meted out by paramilitaries, is that not as bad or worse than beating somebody up. Or is that ignored because its...
I don't see the girls age mentioned in the report, the two attackers only believed Miah had taken photographs of there sister. “This conviction may well put you at risk of being deprived of job opportunities in the future, and that is punishment in itself.” That statement has Cherie Blair written all over it
the sister was 8!it was totally wrong of the neighbour to do what he did. and the boys are well respected and decent guys who have a good education and a fantastic life ahead of them!they fought back in self defence the neighbour shouldn't have provoked them!
and honour killings is against Islam because murder is a sin in itself!
so for those uneducated people out there thats your answer!
no one complains when non asian people beat someone up and get no sentence for it!its all racism i tell u!

This is unacceptable behaviour, and the fact that they have avoided any meaningful sentence just goes to prove that this commuinity has a two tier justice system for some of its members.
