Agard’s multi-million compensation payout
A FORMER Waterhead rugby league star left blind and acutely disabled after he was hit by a motorbike while crossing the road has won a multi-million-pound compensation payout.

Brian Anthony Agard’s life was ruined when he was struck as he crossed Lees Road near the Wellyhole Street junction at Leesbrook in 2003.

His left leg was shattered in the collision and, after surgery to repair the damage, he suffered a range of devastating complications, including a blood clot — leading to brain damage — and was also struck by hospital superbuf MRSA. His leg had to be amputated above the knee.

Mr Agard (44), of Greenacres, was left blind, dependent on a wheelchair and needs round-the-clock care.

Stars of rugby league rallied round to raise money for his care, and through his wife, Maxine, he sued the motorbike rider — Lee Marcus Horrocks, of Greenhill Cottages, Mossley. Motor insurers have agreed to a final settlement of Mr Agard’s damages claim on the basis of 75 per cent liability. Although the exact figures have been kept confidential, the settlement will take the form of a very substantial lump sum — running into millions — plus tax-free payments of more than £100,000 per year to cover the enormous costs of his care.

The judge, Mr Justice Griffith-Williams, said he “unhesitatingly approved” the settlement’s terms which will give Mr Agard financial security for life.

After hearing from Mr Agard’s barrister, Christopher Wilson-Smith QC, the judge paid glowing tribute to Maxine Agard who was her now-husband’s partner at the time of the accident.

He added: “Far from forsaking him, she married him. She has given him very considerable care and, for that, she is due public credit.”

Mr Agard had been with the Waterhead club since he was a young player before retiring in 2002, although he continued training.

He is believed to have been on his way to the club when he was hit by the bike.
