Cleared man gets the boot from UK

Date published: 18 April 2012

A JAMAICAN man twice acquitted by a court after conflicting evidence over assaults — one a manslaughter charge — is to be deported as an illegal immigrant.

Garlett Brown (54), of Shaw Street, Oldham Edge, faced trial over the death of Mbongeni Ndhlovu after a fight and then for assaulting a woman in a separate case.

He was dramatically cleared of manslaughter after a judge directed the jury to a not-guilty verdict over conflicting evidence.

Mr Brown was also found not guilty of assaulting Carol Jackson (57) after a district judge again ruled there was conflicting evidence. He was kept in custody pending his removal from the country.

Mr Ndhlovu (28) died after a fight in Shaw Street resulted in the Zimbawean suffering a serious injury after cracking his head against a wall.

Mr Ndhlovu was taken to hospital after the incident in October 2011, but later discharged himself. He died two days later at Hope Hospital.

Mr Brown’s manslaughter trial collapsed at Manchester’s Minshull Street Crown Court on March 26.

Police said the case is now effectively closed.

Yesterday, Mr Brown was cleared of a further assault charge at Oldham Magistrates’ Court after claiming his landlord and neighbour were conspiring against him.
